A retired West Aurora High School math teacher indicted in 2016 on child porn charges is also accused of having sex with an underage student of his in the 1990s, according to a recent court filing.

The former student came forward after reading about Robert L. James’ child porn case, according to a motion filed by prosecutors asking a judge to let the woman testify at his trial.

James, 63, of North Aurora, is charged in a 10-count indictment with producing child pornography over a span of about four years, possessing images of child pornography involving children under the age of 13 including at least one young girl he knew, and exposing himself to a child he knew while soliciting a sex act. James, free on bond, has pleaded not guilty.

Kane County Judge John Barsanti last month severed the charges against James into three separate trials. James’ attorney had argued trying all 10 counts in a single prosecution would be improper, stating different types of evidence would be needed to prove James’ guilt on the various charges and jurors could issue convictions for the wrong

Now, James will have one trial on two class X child porn charges; another trial on six counts of class 2 child porn charges; and yet another trial on charges of class 3 indecent solicitation of a child and sexual exploitation of a child.

On Dec. 8, Barsanti ordered the trial continued to April 9 and imposed a motion filing cutoff date of Jan. 31.
